Terms of service
Last updated 23 October 2026
These terms cover your use of Thoth: the Thoth apps at app.osthoth.com and the website at osthoth.com (together, “Thoth”). Thoth is run by a company based in the United States. In these terms, “we” and “us” mean that company, and “you” means anyone who uses Thoth. By signing in to Thoth or using osthoth.com, you agree to these terms and to our privacy policy.
1. Schools and the people they invite
Schools use Thoth under a separate written agreement with us. That agreement covers fees, the records we hold for the school and what happens to them when the school leaves. If it conflicts with these terms, the school’s agreement wins for that school.
Staff, parents, family contacts and students use Thoth because their school invited them. If you accept these terms for a school or another organisation, you confirm that you have the authority to do so.
2. Accounts
- Thoth has no public sign-up. Schools, or we on a school’s behalf, create every account.
- Keep your sign-in details to yourself, and tell your school or us straight away if you think someone else has used them.
- You are responsible for what happens under your account, unless it happened because of a failure on our side.
- Your school can change what you can see, or close your account, at any time.
3. Students and children
Students, including children under 13, use Thoth only through an account their school creates. The school is responsible for having the consent or authority the law requires for that, and for supervising how students use Thoth. Our privacy policy explains how we handle children’s information.
4. Using Thoth properly
You agree not to:
- break the law, or use Thoth to deceive or defraud anyone;
- open records you are not meant to see, or try to get around Thoth’s access rules or security;
- upload malware, send phishing messages, or probe Thoth for weaknesses without our written permission;
- copy Thoth’s content in bulk, scrape it, or get around its limits on requests;
- harass, threaten or abuse anyone, or post hateful material;
- upload anything you do not have the right to share, including material that infringes someone else’s rights;
- overload Thoth or interfere with how it runs for others.
5. Your school’s records
The records, files and messages a school and its people put into Thoth belong to the school, or to whoever created them. We do not claim ownership of them.
You give us permission to store, copy, display, send and process that content, worldwide, only as needed to provide Thoth to your school, to support it and to keep Thoth secure. This permission ends when the content is deleted, apart from copies in backups, which are deleted in the normal course. We never use school records to advertise or promote Thoth.
6. Drafts made with AI
Thoth uses AI to draft some of its content, such as records read from files a school uploads. A person reviews and approves every draft before it is saved or sent. Drafts can be wrong or incomplete, so check them carefully. Once you approve a draft, it is your school’s record or message, not ours.
7. Thoth itself
We own Thoth: its software, design, name and logo. While you follow these terms, you may use Thoth for your school’s work. You may not copy, change, resell or take apart Thoth’s software, or use the Thoth name and logo without our permission.
If you send us ideas or feedback, we may use them freely and without paying you.
8. Other services
Thoth may let you sign in with Google or Microsoft, or link to other websites. Those services have their own terms, and we are not responsible for them.
9. Fees
Schools pay for Thoth as their agreement with us sets out. Staff, parents and students do not pay to use Thoth.
10. Suspending and ending access
We may suspend or close an account that breaks these terms or puts Thoth, a school or anyone’s safety at risk. Where we can, we tell the school first. A school can close accounts, or stop using Thoth, as its agreement allows.
When an account closes, its right to use Thoth ends. Sections 5 to 7 and 11 to 13 still apply after that.
11. Our responsibility
We work hard to keep Thoth available, accurate and secure, but we provide it “as is” and “as available”. To the extent the law allows, we give no other promises or warranties, express or implied, including that Thoth is fit for a particular purpose or free of errors.
To the extent the law allows, we are not liable for indirect, special or consequential losses, or for lost profits, revenue or data. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit. A school’s agreement with us sets out our responsibility to that school.
12. Governing law and disputes
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Any dispute about them goes to the state or federal courts in Delaware.
If you live in a country whose laws give you rights these terms cannot take away, such as consumers in the European Union or the UK, you keep those rights and may bring a claim in your own courts.
13. Everything else
- If a court finds part of these terms unenforceable, the rest still applies.
- You may not transfer your rights under these terms. We may transfer ours to a company that takes over Thoth, which must keep these terms.
- If we do not enforce part of these terms straight away, we can still enforce it later.
- These terms, the privacy policy and any agreement with your school are the whole agreement between you and us about Thoth.
- We send notices to the email address on your account, or show them in Thoth. Send notices to us at [email protected].
14. Changes to these terms
When we change these terms, we update the date at the top. If a change matters, we tell schools by email or in Thoth at least 30 days before it takes effect. If you keep using Thoth after that, the new terms apply.
